    The Fifth Circuit Court of Appeals sides with Texas against the Biden Administration’s imposition of vaccine mandates for Texas National Guard troops, holding that the Texas National Guard was operating under STATE authority, not FEDERAL.Texas has a no-mandate policy with regard to vaccination of the Texas National Guard.Federal authority for vaccine mandates related to DoD activities arises from 10 USC 1107(a).The Fifth Circuit has now held that the power of the President of the United States over the military forces of a STATE is LIMITED.This is a huge legal check on Presidential/Federal power.I have no doubt that the Biden Administration will appeal it, but it is a step in the right direction for the Constitution and re-assertion of States’ rights.Of important note, on pages 8-9 of the opinion, the court addresses the issue of Mootness related to jurisdiction and the Congressional directive to have the Executive remove the mandate.The 5th Circuit disagreed with the goverment’s position based on the actions and writings of the Secretary of Defense, determining instead that Secretary Austin merely held imposition of punishment in abeyance.The court called it “Secretary Austin’s Damoclean Sword”On page 10 of the opinion, the 5th Circuit seems especially harsh in noting that while they are remanding the case to the District court for assessment of the applicability of Texas’ APA and Constitutional arguments (as to which more appropriately applies as to relief), the court takes aim directly at the forfeiture and waiver of APA carveouts stating that “carveouts go towards the merits, not towards jurisdiction.”It seems that the court was eager to remind the DOJ that in the failure to plead the carveouts, the Administration lost their argument as to justiciability.But, sue sponte notes that even if they had pled it, it would not have been a limiting factor as to mootness for justiciability.Very interesting.Opinion issued 12 June 2023 at:https://lnkd.in/g27zfitthttps(://)www(.)ca5(.)uscourts(.)gov/opinions/pub/22/22-40399-CV0.pdf[remove parentheticals for direct link]#law #statesrights #mandate #vaccine #covid19vaccine #texas#doj #DOD #army

    Changing views among Republicans have steered the relaxation of childhood vaccine requirements, according to the Pew Research Center. Whereas nearly 80% of Republicans supported the rules in 2019, fewer than 60% do today. Democrats have held steady, with about 85% supporting. Mississippi, which once boasted the nation's highest rates of childhood vaccination, began allowing religious exemptions last summer. Another leader in vaccination, West Virginia, is moving to do the same.An anti-science movement picked up pace as Republican and Democratic perspectives on science diverged during the pandemic. Whereas 70% of Republicans said that science has a mostly positive impact on society in 2019, less than half felt that way in a November poll from Pew. With presidential candidates lending airtime to anti-vaccine messages and members of Congress maligning scientists and pandemic-era public health policies, the partisan rift will likely widen in the run-up to November's elections.

This act, conceived with the intent to shield vaccine manufacturers from liability, unwittingly set a precedent that has reverberated through the years, echoing the grim lessons of the Ford Pinto disaster.The Act was a watershed moment, signaling an era where the guardians of public trust placed economic expedience above the sanctity of human health. It granted immunity to pharmaceutical giants, inadvertently dampening the incentive for the rigorous safety protocols essential in vaccine development. In light of todays' announcement of the first criminal prosecution, we expect many firms having contact with competitors may consider some form of quick internal DD so they don't find competitors are "first in" to get #leniency / #immunity.

    My commentary at the very beginning of the "crises" was simply "Don't discuss medical/chemical interventions unless you also discuss preventative strategies simultaneously". And we saw the complete suppression of "anything" that would support the natural enhancement of our immunity. Though we bitch and complain about corruption in our political and medical system but "we the people" do not take enough responsibility for our own health and have become dependent on drugs to solve our problems, which they rarely do. Most of the drugs given are needed for lifestyle-created problems, improve the lifestyle, and little or no need for the drugs. #choices #lifestyle #naturalhealth #exercise #health #sonotodrugs

    #HumanRights are under threat everywhere. It's not just Palestinian ethnic cleansing - but closer to home abuse of human rights has affected many who took the vaccine. A landmark legal case has been launched against #AstraZeneca - where it is claimed that vaccine efficacy was vastly overstated. This case is about the human right of 'informed consent'.This is hopefully just the beginning of holding #bigPharma to account or at least getting answers. Profits are fine - but these days the corporates and politicians seem pretty comfortable with deaths-for-profit (#opioids #war) and our regulators have been corrupted by money. Cheaper, less experimental therapies for young persons who were not at severe risk were discouraged and not investigated further given the lack of profits in saving lives 'cheaply'.If BigPharma are not held to account - then we deserve every undisclosed side-effect from every experimental vaccine to every #pandemic - real, exaggerated or imagined.#Covid was a crisis situation, decisions had to be made quickly - but were we told everything we needed to know to make the decision that was best for us and our families? Where the hell was the UK regulator (MHRA)?The World Health Organization was still - on the 13th of June 2022 stating the vaccine was safe and effective - when almost all countries stopped recommended it to young people from the summer of 2021 after the side effects were becoming apparent. This is the same #WHO trying to obtain supra sovereign #pandemic powers together with the control of information - control of the narrative to ensure one approved truth.Informed Consent is a human right. Patients should not be coerced into medical procedures, surgeries, or treatments.     Opposing the Jan. 6 committee is only a small part of the GOP’s antidemocratic agenda. Republican legislatures arelimiting voting rights, ostensibly to fight nonexistent voter fraud, while MAGA minions run for positionsoverseeing electionsto ensure that Trump will never lose again.There are other passions that animate the Republican base, of course. Republicans embrace a twisted philosophy of “medical freedom,” eschewing vaccine mandates and even vaccines themselves. Indeed, one of the few issues where Trump has lost the GOP base is in his endorsem*nt of vaccines. The result of the right’s anti-vaccine zeal is that the 10stateswith the most covid deaths per 100,000 residents in 2021 all had Republican governors.By a not-so-odd coincidence, thetop 10states with the most gun deaths per capita are also red bastions. YetRepublican legislaturesare making it easier to buy firearms and carry them in public. Republicans have become the party of death even as they pass legislation under the “pro-life” banner.
